MYTHS ABOUT EASEMENTS
FOR VERMONT REAL ESTATE BROKERS AND SALESPERSONS
 
This course has been approved by the Education Subcommittee of the Vermont Real Estate Commission for four (4) clock elective hours for activating or renewing a real estate license in Vermont.  Level of Study: Intermediate, appropriate for Brokers and Salespersons
 
 
LEARNING OBJECTIVES
 
* To review basic law of easements
* To identify common misunderstandings and pitfalls among agents relating to easements
* To develop appropriate listing and marketing strategies regarding easements
* To develop due diligence skills as buyer representative regarding easements
 
 
METHODS OF INSTRUCTION
 
Lectures first review how the whole matter of easements relates to the practice of real estate brokerage.  Time is taken to emphasize the avoidance of the practice of law including a discussion exercise.  Next, the lectures review the basic principles of easement law including the definition of easement and servitude, distinguishing other interests in property, how easements are created and terminated, and the scope of easements.  Next the lectures address suggested due diligence for real estate agents regarding easements.  The second half of the course then addresses seventeen (17) specific myths about easements which might cause an agent to fail to represent the interests of clients or mislead customers.  The approach of the course shifts from lecture to discussion controlled by specific examples, discussion questions, statements of the law, and some recommendations.  Active participation is encouraged.  The course booklet ends with some interesting points regarding Vermont easements and some hot current topics in this area of law.  This Course is appropriate for the beginner as well as the experienced licensee.  Everyone will benefit if participants share experiences.  This too will be encouraged as time allows.  This Course is suited for private offerings to small groups and single firms, as well as larger groups.  In the smaller offerings, classroom style instruction will be in roundtable format.  Audio/Visual Aids not used. 
 
 
COURSE CONTENT
 

Hour 1:  Introduction; summary and explanation of course scope and objectives; begin the basic law of easements; Hour 2: complete the basic law of easements; suggested due diligence for real estate agents regarding easements; Hours 3 and 4: myths about easements; some interesting points regarding Vermont easements; and conclusion.

 
 
COURSE MATERIALS
 

Participants receive a sixteen page course outline containing the order of discussion, various text boxes focusing on particular topics, and the exercises planned for the review of basic principles and the review of myths about easements.  There is no separate textbook.

Instructor: Randall F. Mayhew, Vermont Attorney, Adjunct Professor of Law at Vermont Law School; longtime instructor of real estate professionals and law students regarding real estate transactions, and practicing attorney dealing with real estate transactions
 

 

Fees: General classroom offering: General fee is $80.  Provider reserves the right to cancel classes with fewer than ten persons pre-enrolled.  For private or group offerings the fee is negotiable depending upon number of participants, whether outside participants are allowed, timing, and provision of classroom space and enrollment assistance.

 

Dates, Times, and Locations offered: This course will be offered on an ongoing basis throughout the state.  Dates, times, and locations will be posted on the website and may also be obtained by email or phone request to MayhewSchool@aol.com.  Information will also be made available in targeted mailings to licensees.
